The Space

This property is located on a 1/4 acre corner lot. The entire property is extensively landscaped. You can enjoy the backyard in total privacy from any neighbor. The gorgeous pool contains a waterfall and has LED lighting.

Guest Access

Guests have access to all parts of the property, including the washer and dryer in the garage.

Property Details

By booking, the Guest agrees to all House Rules, including a rental agreement. The rental agreement may be previewed at the bottom of the House Rules below.

No rental to Broward or Miami-Dade residents.

No parking on grass.

No radios, boom boxes, or sound systems of any kind allowed on the patio.

No parties or events.

No reservations accepted for guests with children under twelve years old.

Only 3 vehicles may park in the driveway.

No animals of any kind are allowed.

Pool temperature is maintained at 80 degrees from December 1st to April 1st.

Temperature may be increased for a fee of $15 per day or $90 per week.

There will be an additional charge of $65 per night for any guest that is over the number of guests on the reservation. For example, if the reservation is for four guests, a fifth guest would cause the $65 per night extra guest fee to be imposed.

The property is located in a neighborhood that makes a rental car almost unnecessary. Dining, shopping, entertainment are all easily accessed by walking. Multiple parks are nearby and in walking distance.

The attractions in downtown Fort Lauderdale on Las Olas and the Fort Lauderdale beaches are each less than a fifteen minute Uber ride away.

Rental Contract for 124 NE 21st Street; Wilton Manors, FL 33305

This Vacation Property Rental Agreement (hereinafter referred to as “Agreement”) is for the property located at 124 NE 21st Street; Wilton Manors, FL 33305, a house hereinafter referred to as “the property”.

This agreement is between the guest booking the property on Airbnb, hereinafter referred to as "Renter", and 124 NE 21st Street LLC, hereinafter referred to as "Owner".

By booking this reservation on Airbnb, Renter agrees to all terms of this agreement.

RESERVATION

Third party reservations are not permitted. The individual paying for the reservation with Airbnb must also be the Renter and must occupy the home for the term of the contract.

AGENT/MANAGER:

Renter acknowledges that Dettman Realty Group LLC, “Property Manager” is acting solely as a property manager for the property, and Renter agrees to indemnify and hold harmless the Property Manager from all claims and damages arising out of this Lease.

Time of Check-In and Check-Out

The dates of the check-in and check-out are the dates agreed to at the time of booking on the reservation made by the Renter.

Adhering to the check-in/check-out time allows Owner's crews the time required to inspect and prepare the home for incoming guests. Renter is not permitted to park in the driveway outside the term of the rental agreement. The driveway must remain free and clear for service vehicles (see "SECURITY DEPOSIT GUIDELINES" below).

RENTAL RATE:

The rental rate is the rate agreed to by the renter at the time the reservation was booked with Airbnb.

GUEST OPTIONS (if any):

Pool Heat: Pool heat will be maintained at 80 degrees. If Renter requests increased heating, a charge of $15 a day shall be assessed.

STATED OCCUPANCY

Renter confirms that the number of guests listed on the reservation at the time of booking with Airbnb. Renter understands that occupancy exceeding the stated number is not permitted and will result in complete forfeiture of the security deposit (see "SECURITY DEPOSIT GUIDELINES" below).

GROUPS.

This home is a single-family dwelling in a QUIET, safe, established, residential neighborhood. This home is intended only for mature adults and families seeking quiet enjoyment. The Wilton Manors Police Department monitors all homes for compliance with city regulations regarding noise and occupancy as outlined in this contract. Occupancy limits must be observed. Any events or gatherings must be authorized in writing by Property Manager on a case by case basis. Group reservations are approved based on the advertised age requirement. Each person in the group must meet the minimum age requirement.

MAXIMUM OCCUPANCY.

Maximum overnight occupancy is determined by the total number of guests listed on the reservation at the time of booking with Airbnb. Overnight occupants will be defined as individuals occupying the premises anytime between midnight and 8 AM. Overnight occupants are required to sleep only on the beds and/or sofa bed provided specifically for that purpose, up to two individuals per sleeping room, and may not use other furniture for sleeping.

QUIET ENJOYMENT.

Wilton Manors has an ordinance regarding noise. Accordingly, sound shall not be plainly audible for a period of one (1) minute or longer at a distance of twenty-five (25) feet or more when measured from the source property line between the hours of 10:00 p.m. and 7:00 a.m. daily. Additionally, sound shall not be plainly audible for a period of one (1) minute or longer at a distance of fifty (50) feet or more when measured from the source property line between the hours of 7:00 a.m. and 10:00 p.m. daily. Further, sound shall not be plainly audible at a distance of twenty-five (25) feet or more from a motor vehicle or any other sound source.

Accordingly, Renter MUST adhere to the following recommendations:

• Supervise children at the pool area at all times.

• Conclude outdoor activities, including pool use by 10 PM, when noise curfew begins.

LOCAL ORDINANCES.

Renter agrees to obey all Wilton Manors ordinances and vacation rental requirements, including those pertaining to noise and occupancy, as outlined in this contract. Violation of any federal, state or local law or ordinance, resulting in intervention by law enforcement, will result in the following: The reservation will undergo immediate termination, Renter will immediately proceed to remove all personal possessions and to vacate the premises, without refund, under supervision by Owner or representative(s), and Owner will resume immediate possession of the property.

NO SMOKING.

This is a NON-SMOKING house. Any evidence of smoking inside the house will automatically result in forfeiture of the entire security deposit. Smoking is allowed outside only at a safe distance from the home. Smoking outside is not allowed near open doors and windows. Heavy odors of smoke left in home will result in additional cleaning fees. Renter is responsible for removing all remnants of smoking from the property. Failure to do so will result in additional cleaning fees. The fees will be deducted from any security deposit.

POOL MAINTENANCE

Pool heater, when in use, is set at a comfortable 80 degrees. Cool weather may not allow the pool to maintain this temperature. Temperature is not guaranteed. When outside temperature is too low (especially overnight), it may be impossible for pool heater to achieve desired pool temperature. Tampering with the pool heater or other pool equipment will result in forfeiture of security deposit.

PLEASE NOTE: Pool is serviced once per week and has been prepared for Renter's arrival. Between service calls, Renter is responsible for removal of leaves and other debris from pool, using tools provided by Owner. Renter is also responsible to keep beach sand out of the pool. Sand accumulation in the pool is easy to avoid and very difficult to remove. Accordingly, Renter should use shower before entering the pool to keep the water clean and to prevent sand and tanning products from damaging equipment. Additional charges will apply if the pool must be treated for accumulation of excess sand, as this requires special management before the next guest arrives.

POOL

Renter accepts responsibility to read and abide by all safety instructions provided in the contract and welcome book pertaining to use of pool, hot tub and surrounding areas, and Renter agrees to contact Reservation Manager for clarification if needed. Owner does NOT provide child-safety fencing around the pool or hot tub. Renter accepts full responsibility to observe any children and all others on the premises at all times in order to prevent accidental drowning or other injury. Any individual with health problems should consult with his or her physician before using the pool or hot tub. No one should use the pool while under the influence of drugs or alcohol.

POOL

• Use of the in-ground swimming pool is only for guests who know how to swim and is AT ONE’S OWN RISK.

• Use of hose is mandatory to remove beach sand and lotions before use of pool.

• Children under 16 years of age must be accompanied by an adult.

• Never swim alone.

• Running and jumping are not permitted in the pool area.

• Avoid use of glass in the pool areas.

• Diving is not permitted.

• Outside gates are to remain closed and latched when not in use and are not to be propped open for any reason.

• Use of tubes or floats is not permitted.

• Never add body wash, shampoo, bubble bath or other chemical agents to pool.

POOL WAIVER. This waiver applies to named Renter(s) as well as all other occupants and guests of Renter, and anyone whom Renter intentionally or unintentionally permits access to the pool area.

I fully understand and acknowledge the rules and polices stated above. In addition, I understand and acknowledge that (a) risks and dangers exist in my use, my family and guest(s) use of the pool equipment (b) my participation, my family and guest(s) participation in such activities and/or use of such equipment may result in injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of Renter or Renter’s guests, the negligence of the participants, the negligence of others, accidents, breaches of contract, the force of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation, my family and guest(s) participation in these activities and/or use of equipment, I hereby assume all risks and dangers and responsibility for any injury, illness, losses and/or damages to my family, my guest(s) and/or the equipment. I will be held liable for serious damages to the pool and/or pool equipment above the amount of the security deposit.

I, on behalf of myself, my personal representative and my heirs, hereby voluntarily agree to release, waive discharge and hold harmless, defend and indemnify owners and their agents, from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use, my family and guests use of in-ground pool, hot tub and/or equipment or my participation, my family and guest(s) participation in pool or hot tub activities.

I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future against the owners and agents of the property.

By Agreeing to the contract and reservation, I acknowledge that: I HAVE READ THE ABOVE WAIVER AND RELEASE AND AGREE TO THE ABOVE EXEMPTING AND RELIEVING THE OWNER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

PARKING REQUIREMENT.

Parking is restricted to the designated off-street parking zone and is limited to standard size automobiles or SUV's. COMMERCIAL VEHICLES, RECREATIONAL VEHICLES (RV’S), BOATS, TRAILERS, AND MOTORCYCLES ARE STRICTLY PROHIBITED. FAILURE TO COMPLY WILL RESULT IN FULL FORFEITURE OF SECURITY DEPOSIT. On-street parking is not permitted for occupants or guests at vacation rental homes in Wilton Manors. No parking in grass.

CANCELLATIONS.

Travel insurance is highly recommended. The cancellation policy is that agreed to at the time of booking.

FALSIFIED RESERVATIONS.

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or processing fee, and the party will not be permitted to check in. If a reservation is recognized, subsequent to check-in, to have been falsified, the following will occur: The reservation will undergo immediate termination, Renter will immediately proceed to remove all personal possessions and to vacate the premises, without refund, under supervision of Owner or representatives, and owner will resume immediate possession of the property.

WRITTEN EXCEPTIONS.

Any exceptions to the above-mentioned policies must be approved in writing in advance.

HURRICANE OR STORM POLICY.

Weather is not guaranteed. Travel Insurance is highly recommended.

RELEASE OF RESPONSIBILITY.

Renter accepts occupancy of the premises and relieves Property Manager of any responsibility and all liability arising during or from Renter's use of property.

ASSIGNMENT.

This license agreement is not assignable or transferable; nor is property to be sublet.

ACCESS TO PROPERTY.

Renter shall not unreasonably withhold consent to Owner or his representatives, including property manager, to enter the grounds and/or dwelling unit from time to time to inspect the premises, maintain the landscape and/or pool/hot tub (if present), provide pest management services, make necessary or agreed repairs, decorations, alterations, or improvements; supply other agreed services; or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workers, or contractors.

Landscape maintenance, pool service, and pest management services occur on a regularly scheduled basis. Service schedule may vary subject to weather and holidays. Renter acknowledges that these services are essential to maintain the property and cannot be rescheduled. Renter agrees to remain clear of yard and pool areas while the above services are being performed. Refusal to provide access to the property for these services will result in complete forfeiture of the security deposit.

Owner or representatives may enter the dwelling unit upon reasonable notice to the Renter and at a reasonable time for non-emergency repair of the premises. “Reasonable notice” for the purpose of non-emergency repair is notice given at least 12 hours prior to the entry, and reasonable time for repair shall be between the hours of 9 a.m. and 4:00 p.m.

Owner or representatives may enter the dwelling unit when necessary at any time:

• With the consent of Renter;

• In case of emergency, including emergency repair. "Emergency repair" is defined as repair which requires immediate attention to prevent potential property damage or personal injury.

• When the Renter unreasonably withholds consent;

• When the Renter is absent from the premises for a period equal to one-half the time of the rental period; or

• When Wilton Manors officials or law enforcement report any form of complaint against Renter, or when Renter is in violation of any city ordinances or vacation rental requirements.

Owner shall not abuse the right of access nor use it to harass the Renter.

ATTORNEY'S FEES.

In any legal action to enforce the terms hereof or relating to the premises, regardless of the outcome, the prevailing party shall be entitled to all costs incurred in connection with such action, including reasonable attorney's fees. Renter acknowledges that all attorney’s fees and other fees as noted above shall be classified and billed to Renter as “added rent”.

HOLD HARMLESS.

Owner attempts to maintain the property in the best possible condition. Owner offers no guarantees, expressed or implied, regarding suitability for any purpose. Owner does guarantee that appropriate repair and/or replacement will be performed as soon as possible under prevailing circumstances. It is Renter's responsibility to immediately notify Owner or his Agent in writing of any property-related issues that Renter's party incurs during their stay so that the repair and/or replacement may be promptly addressed. Owner shall not be responsible retroactively for any issue occurring prior to the time Renter has provided owner with written notification of said issue. Owner shall not be responsible for any injury, personal property damage or inconvenience suffered by Renter or Renter’s invitees, resulting from circumstances for which owner has no immediate control or knowledge. These circumstances may include, but are not limited to, the following: (i) malfunction of any equipment, furniture or amenities; (ii) power outages; (iii) flooding; (iv) adverse weather and/or road conditions; (v) construction in the area; (vi) landscape issues, e.g.) falling branches, leaves, coconuts or seed pods, (vii) the presence of insects, mammals, reptiles, amphibians, or other indigenous animals on the property, (viii) wet or slippery surfaces; (ix) property not decorated and/or accommodated to Renter’s individual taste; (x) allergic reactions or intolerance on Renter’s part to any property-related exposure. Owner shall not be responsible for malfunction of plumbing fixtures or other equipment if determined to be secondary to improper use by Renter. Owner shall not be held liable, or otherwise take any responsibility, for any injury or personal property damage suffered by Renter, and/or Renter’s invitee, that is caused or permitted to be caused by the intentional, unintentional, negligent, or careless acts of said Renters, and/or invitees. By the written or electronic endorsement of this agreement, Renter agrees to forever hold harmless and indemnify Owner from any liability and/or responsibility arising therefrom.

ATTENTION WILTON MANORS RENTERS.

This information is to be provided to the renter as required by the City of Wilton Manors.

• Trash Pickup: Trash pick-up Tuesday AM and Friday AM; Recycling pick-up Friday AM. Please bag all trash before placing in outdoor trash can. Pull outdoor trash can and/or recycling can to curb the night before scheduled pickup. Recycling should not be bagged. It must be placed loosely in green recycling can or city will not pick it up. City also refuses to pick up recycling mixed with trash. If in doubt as to whether an item is recyclable, place in blue trash can.

SECURITY DEPOSIT GUIDELINE.

Below is a list of situations that could affect one’s security deposit. We advise avoidance of the following circumstances, where possible, to prevent any unnecessary charges: 1) Renter arrives at property earlier than check-in time stated on lease. 2) Renter vacates property later than check-out time stated on lease. 3) Renter moves furniture but does not restore it to its original position. 4) Renter causes damage to property. 5) Renter does not adhere to the NO SMOKING policy. 6) Renter does not adhere to stipulations under PET AGREEMENT. 7) Extended cleaning is required (see "CHECK-OUT GUIDE"). 8) Overnight occupancy is exceeded. 9) General occupancy is exceeded. 10) Private trash removal services are required to handle excess trash or recycling. 11) Owner is contacted by township officials or law enforcement, stating any form of complaint against Renter. 12) Any of the following have to be treated for accumulation of excessive amounts of sand: pool interior of home, including bathtubs, sinks and showers, washer and dryer. 13) Stipulations pertaining to quiet enjoyment or use of premises are violated. 14) Plumbing malfunction results from disposal of inappropriate items in sinks, toilets, showers/tubs. 15) Appliances require service due to improper use. 16) Renter fails to follow stipulations noted under "ACCESS TO PROPERTY". 17) Renter fails to follow stipulations noted under "POOL RULES". 18) Renter parks on grass. 19) Professional services are required to manage any type of infestation or contamination of the property caused by Renter.

CHECK-OUT GUIDE

The following is a list of situations that could affect one’s security deposit. We advise avoidance of the following circumstances, where possible, to prevent any unnecessary charges: Owner's cleaning service will provide a cleaning of the property after Renter's departure. Renter should complete the following before leaving: 1) Make sure all outside areas and laundry room are in order and free of any personal items. 2) Do NOT use bleach on any area of the property. 3) If grill was used, scrub the grate of the grill with grill brush provided to remove all heavy grease and food debris. Close the grill lid when not in use to prevent rain water from filling the grill. 4) Put all trash into plastic bags. Place trash into appropriate outside container. 5) Turn off all electronic devices, including lights and ceiling fans. Check to see that the remotes for the TV’s, DVD’s, fans, and other electronic devices are present near the units they control. All A/C thermostats should be set to 78 degrees before departing. 6) Please return all furniture to original position. 7) All doors and windows should be closed and locked. 8) Do not leave vehicles in the parking area after check-out time.
